Allegro Gate Automation Pty. Ltd. – The Vendor
Limited Warranty Terms

 

  1. All goods purchased from The Vendor, are covered by warranty for defects instigated by workmanship and/or materials, under normal uses and as per the terms below.
  2. The warranty is automatically provided but cannot be applied in the total or partial absence of the required documentation.
  3. Relative tax invoice, payment receipt and installation documents must be provided with the warranty claim.
  4. The warranty periods are from the date of purchase, for the items listed below at 4.1. and 4.2.
    1. 12 month limited warranty is provided for all goods purchased from The Vendor
    2. 36 months for the following KingGates brand equipment:
      1. Electronic motors
      2. Gear motor units
      3. Electronic control units
      4. Boom gates
  5. The Vendor liability is limited to defects attributable to manufacturing defects.
  6. All failures or nonconformity must be reported to the seller within 30 days from the discovery of the defect.
  7. Complaints regarding the product cannot be taken into consideration if they refer to features that are not indicated in the technical specifications or do not relate to the normal use of the product or if the product has not been installed in accordance with industry standard and inspected by technicians or approved by The Vendor.
  8. The warranty is a return for repair basis, the customer is liable to pay the cost of the return shipping of suspected faulty items to The Vendor at which address provided.
  9. The Vendor shall not be liable in any way for any damages, consequences or losses either direct or indirect caused to any persons, things, or pets, which occurred following a failure of any product supplied by The Vendor.
  10. The Vendor shall not be liable for costs involved in intervening, inspecting and/or replacing faulty items and/or fault finding at installation sites. Such requirements are subject to the payment of a call out charge at the current rate.
  11. If a defect arises and a valid claim under this Limited Warranty is received by The Vendor after the first one hundred and eighty (180) days of the warranty period, The Vendor is entitled to charge the customer for any reasonable shipping and handling costs made in connection with the repair or replacement of the goods.
  12. In any case the customer should in the discovery of any presumed defect or fault immediately stop using the product or component presumed to be defective.
  13. It is compulsory for the customer to store the product or component it believes to be defective in a suitable place to the Vendor for it’s necessary investigations and in any case adopt all measures necessary to mitigate further damage to the product or component. 
  14. Claims must comply with any other return procedures stipulated by The Vendor, if any.
  15. This limited warranty cannot be applicable if:
    1. The goods have been unsealed, changed, dismantled, or repaired by someone not authorised by The Vendor;
    2. Physical damage to the surface of the goods or calibration of it;
    3. Components which are not original KingGates or supplied by The Vendor have been installed;
    4. Part or parts of the products or components are missing;
    5. Non-compliance with the installation instructions supplied with the goods;
    6. Non-compliance with the user instructions supplied with the goods;
    7. Neglect, abuse or misapplication of the product;
    8. Any disfigurement, removal, tampering of any labels attached to the product;
    9. Damage by accident, misuse, moisture, liquids, proximity or exposure to heat;
    10. Damage by power supply as excessive burst of voltage or “dirty power”.
  16. This Limited Warranty does not affect any legal rights under any applicable state or national legislation governing the sale and warranty of consumer goods.
  17. This Limited Warranty is non-transferable.
  18. In the instance of a suspected warranty claim the customer must:
    1. Contact The Vendor within 30 days;
    2. Forward the respective documentation to the Vendor;
    3. Return any suspected faulty items or components to the Vendor for inspection;
    4. If the items or components are required to be replaced before being returned the customer is to pay for these items in full during the warranty assessment process;
    5. If the item is covered by warranty the customer will receive a refund of the cost of the replacement item;
    6. If the equipment is found to be in working order the customer may be charged a restocking fee at 20% of the retail price;
    7. If the warranty conditions are not met due to the incorrect use of the system, component or parts, The Vendor reserves the right to charge the customer the cost for the intervention and travel expenses per working day of inspection;
    8. If defects are found which result from the incorrect use of the system installation, configuration, software changes, The Vendor reserves the right to charge intervention and inspection costs.
